Terms of Use

These Terms of Use ("Terms") govern your access to and use of cresve.com and the Cresve platform (the "Service") provided by Cresve Ltd, a company registered in Scotland, United Kingdom ("Cresve", "we", "us" or "our"). By using the Service, you agree to these Terms.

1. Eligibility and accounts

You must be at least 18 years old and authorized to bind your organization to enter into these Terms. You are responsible for the activity that occurs under your account and for keeping your credentials confidential.

2. Acceptable use

You agree not to:

  • Use the Service to violate any law or third-party right.
  • Reverse engineer, decompile or attempt to extract the source code of the Service.
  • Use the Service to build a competing product or to train a foundation model that competes with Cresve.
  • Interfere with the integrity or performance of the Service.

3. Customer data

You retain all rights to data you provide to Cresve ("Customer Data"). You grant Cresve a limited, worldwide license to process Customer Data solely to provide and improve the Service for you. We will not sell Customer Data or use it to train third-party models.

4. AI outputs

Cresve's outputs are decision support, not financial, legal or professional advice. Forecasts, scenarios and recommendations are probabilistic and may be incorrect. You are responsible for the decisions you make based on Cresve's outputs.

5. Fees

Paid features are billed according to the order form or pricing page applicable to your account. Fees are non-refundable except as required by law or as expressly stated in your order.

6. Confidentiality

Each party agrees to protect the other's confidential information using the same standard of care it uses to protect its own (and no less than a reasonable standard).

7. Intellectual property

Cresve and its licensors own all right, title and interest in and to the Service. No rights are granted other than as expressly set out in these Terms.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Sections that by their nature should survive termination will survive.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential or punitive damages. Each party's total aggregate liability arising out of or relating to these Terms will not exceed the amounts paid by you to Cresve in the 12 months preceding the event giving rise to the claim.

11. Governing law

These Terms are governed by the laws of Scotland. The parties submit to the exclusive jurisdiction of the courts of Scotland for any dispute arising out of or relating to these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be communicated through the product or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
